Judge tosses out suit challenging Brown

first_imgSACRAMENTO – A judge has thrown out a lawsuit from a group of Republicans who claimed Attorney General Jerry Brown was unqualified to run for that position last November because he had not practiced law for a full five years before the election. Although Brown’s membership to the State Bar of California was inactive from 1997 to April 2003, the Democrat was still eligible to practice law and had been eligible since he was admitted to the bar more than 40 years ago, Sacramento County Superior Court Judge Gail Ohanesian said Friday. California law requires that candidates for attorney general be eligible to practice before the state Supreme Court for at least five years before taking office. “The intent of this law was not to prevent someone in the circumstances of this candidate to be excluded from office,” Ohanesian said. 160Want local news?Sign up for the Localist and stay informed Something went wrong. Contra Costa County Republican Central Committee Chairman Tom Del Beccaro and other party activists filed the lawsuit to block county election officials from counting votes for the former governor and Oakland mayor, who was sworn in as attorney general last month.
